Description
NFT stands for Non-Fungible Token, a digital asset with indivisible, irreplaceable, and unique characteristics. NFT application scenarios are diverse, including digital collectibles, music, artwork, and in-game tokens. The platform is an online trading platform that integrates functionalities for NFT such as selling, buying, pending orders, auctions, and bidding functions. You can obtain NFT by buying at a quoted price or bidding at an auction. You can find and buy your favorite NFT works through the search function. The issuer or creator owns the copyright of the NFT. Unless otherwise specified by the platform, the NFT you own cannot be used for commercial purposes and is exclusively intended for collections.
Ownership
（a）Unless we state otherwise in writing, the Services, and all content and other materials contained therein, including but not limited to the REVIVAL logo and all graphic design, text, graphics, images, information, data, software, sound files, other files and their arrangement (collectively, the "Content") are the exclusive property of REVIVAL or our affiliates, licensors or users.
（b）The REVIVAL logo and any REVIVAL product or service name, logo, or slogan accompanying the Services are trademarks of REVIVAL or our affiliates and may not be copied, imitated, or used, in whole or in part, without our prior written consent. No one may use meta tags or other "hidden text" displaying "REVIVAL" or any other name, trademark, product, or service name of REVIVAL or our affiliates without our prior written permission. In addition, all other trademarks, registered trademarks, product names, and REVIVAL names or logos referenced in the Service are the property of their respective owners. They may not be copied, imitated, or used, in whole or in part, without the consent of the applicable trademark holder. Reference to the name, trademark, manufacturer, supplier, or other information of any product, service, process, or additional information does not constitute or imply endorsement, sponsorship, or recommendation by REVIVAL.
（c）You hereby agree that if you purchase an NFT on REVIVAL, you will be granted ownership of such NFT and its ancillary rights, which may not include the intellectual property rights on which the NFT Content is based. We will not provide you with any other rights to the NFTs you purchase on REVIVAL other than the use of the Service on the Platform.
Fees
Each transaction on the Platform is subject to a fee charged to support the daily operation of the Platform. You agree to pay the Platform any transaction fees for the purchase of NFTs and authorize the Platform to debit such fees directly from your account. You understand and agree that all fees are initiated, transferred, or processed directly through one or more smart contracts on the IOST blockchain network. You hereby acknowledge, agree, and accept the proceeds from the sale of NFTs on the Platform. You hereby agree and accept the results of the settlement and execution of fees and proceeds by the Smart Contracts.
Exposures
The artist accepts and confirms:
（a）The price of blockchain assets is highly volatile. Price fluctuations of other digital assets may have a significant adverse effect on the prices of the NFT and are also subject to significant price fluctuations. We do not guarantee that any purchaser of NFT will not incur a loss.
（b）Our services do not include storing, sending, or receiving crypto assets. This is due to the nature of crypto-assets, which exist only by virtue of the record of ownership maintained on their supporting blockchain. The transfer of crypto assets takes place only within the supported blockchain, not in the service.
（c）In the creation and development of distributed ecosystems, underutilization or considerations of public interest may adversely affect the development of such ecosystems and related applications and, as a result, may adversely affect the potential utility or value of its crypto-assets.
（d）The regulatory regime for blockchain technology, cryptocurrencies, and tokens is not 100% complete. New regulations or policies may have a significant adverse effect on the development of the Services and the utility of crypto assets.
（e）The Service will rely on wallets (i.e., third-party platforms) to complete crypto-asset transactions. Access to and use of the Services will be affected if: (i) we are unable to maintain a good relationship with the providers of such platforms. (ii) there is a change in the terms and conditions or pricing of such platform providers.（iii）we breach or fail to comply with the terms and conditions of such platforms.(iv) any such platform loses market share or becomes unpopular or unavailable for an extended period of time, access to and use of the Service will be affected.
（f）There are risks associated with the activity of purchasing crypto assets, including, but not limited to, purchasing counterfeit assets, mislabeled assets, assets susceptible to metadata decay, flawed smart contract assets, and assets that may not be transferable. REVIVAL reserves the right to hide collections, contracts, and assets affected by any of these issues or otherwise. Assets purchased by Users may not be accessible on REVIVAL. In no event shall the inability to view owned assets on REVIVAL be grounds for a claim against REVIVAL.
Disclaimers
The platform shall not be liable for any loss nor assume any liability to users due to the use of any crypto-assets, including but not limited to any loss, damage, or claim arising from the following:(A) User errors, such as forgetting a password, scheduling a transaction incorrectly, or entering an incorrect address.(B) Server failure or loss of data.(C) Crashed wallet files.(D) Unauthorized access to the application.(E) Any unauthorized third-party activity, including but not limited to viruses, phishing, brute force attacks, or other means of attacking the Service or assets.
REVIVAL is not responsible for losses caused by vulnerabilities or any malfunction, abnormal behavior of the software (e.g., wallets, smart contracts), blockchain, or any other feature of the Crypto Assets. REVIVAL is not responsible for any losses resulting from delays in reporting (or failure to report at all) any problems with the blockchain backing crypto assets by the developers or representatives, including forks, technical node problems, or any other problems resulting in loss of funds.
Modifications to the Service
We reserve the right to modify, suspend or discontinue, temporarily or permanently, the Services (or any feature or part thereof) at any time in our sole discretion and without liability.
Governing law and jurisdiction
This Agreement shall be governed by and shall be conclusively construed in accordance with the laws of Singapore.
